Terms of Service

These Terms of Service ("Terms") govern your access to and use of KaizenShots, operated by KaizenRise ("we", "us"). By creating an account or using the service, you agree to these Terms.

1. The service

KaizenShots provides AI-powered photo feedback, plus optional community features (Discover, Exposures). Free and Pro tiers are available. Pro is a paid subscription billed via Razorpay.

2. Eligibility and account

• You must be at least 13 years old (16 in the EEA/UK) to use KaizenShots.
• You are responsible for the security of your account and password.
• You are responsible for all activity that happens under your account.
• One account per person; do not share accounts or transfer them.

3. Your content

You retain ownership of photos and text you upload. You grant us a worldwide, non-exclusive, royalty-free license to store, process, transmit, and display your content for the purpose of operating the service, generating feedback, and providing features you opt into (such as Discover or Exposures).

You represent that you have the rights to the content you upload, that it does not infringe anyone's rights, and that you have any necessary permissions from people depicted in the photo.

4. Acceptable use

You agree not to upload, submit, or post:

• Sexually explicit content, content sexualising minors, or non-consensual intimate imagery.
• Content that infringes copyright, trademark, or other intellectual-property rights.
• Content generated wholly by AI image generators, when submitted as a photograph.
• Hateful, harassing, or threatening content, or content targeting individuals or groups.
• Content that violates applicable law.

You also agree not to:

• Reverse engineer, scrape, or abuse the service.
• Probe, scan, or test the vulnerability of the service without permission.
• Use the service to build a competing AI feedback product.
• Impersonate others or misrepresent your affiliation.

5. Reports, moderation, and our enforcement rights

Other users may report content they believe violates these Terms. We review reports and may, at our sole discretion, take any of the following actions:

• Remove or hide a photo from public surfaces.
• Disqualify a submission from an Exposure (including after a winner is announced, if the violation is discovered later).
• Suspend or terminate your account.
• Decline to provide service to anyone, for any lawful reason.

Three-strike rule. If three or more of your photos are blocked for policy violations, your account is automatically suspended. Suspension is cumulative across the lifetime of the account.

We may notify you of enforcement actions by email or in-product notice. You may contact support@kaizenshots.ai to appeal.

6. Subscriptions, billing, and cancellation

• Pro subscriptions are billed monthly via Razorpay at the price displayed at checkout.
• You may cancel your subscription at any time from your account settings. Cancellation stops future renewals.
• We may cancel or refuse to renew subscriptions, including for violations of these Terms.
• Refunds are governed by our Refund Policy.

7. AI output

AI feedback is produced by third-party models and may contain errors or subjective judgments. It is guidance, not professional advice. You are responsible for your own creative decisions.

8. Termination

You may delete your account at any time. We may suspend or terminate your account if you violate these Terms, if required by law, or if the service is discontinued. On termination, your right to use the service ends; sections of these Terms that by their nature should survive (ownership, disclaimers, limitation of liability) will survive.

9. Disclaimers

The service is provided "as is" and "as available", without warranties of any kind, express or implied, to the maximum extent permitted by law. We do not warrant that the service will be uninterrupted, error-free, or meet your specific requirements.

10. Limitation of liability

To the maximum extent permitted by law, KaizenRise and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the service. Our total liability for any claim arising out of these Terms or the service will not exceed the greater of (a) the amount you paid us in the twelve months before the claim, or (b) INR 5,000.

11. Indemnification

You will defend and indemnify us against claims arising from content you upload or from your violation of these Terms.

12. Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-law rules. Courts in Bengaluru, Karnataka have exclusive jurisdiction over any dispute, subject to mandatory consumer rights in your jurisdiction.

13. Changes

We may update these Terms. Material changes will be notified by email or in-product notice. Continued use after the change means you accept the updated Terms.
